Gen6 Terms of Service

1. Definition of Service

Service means the Gen6 web and mobile applications, APIs, integrations, and related software, content, and functionality provided by Gen6 for AI-driven data processing, automation, and workflow execution. The Service also includes any hosted AI interfaces, documentation, and support channels made available by Gen6.

The Service incorporates artificial intelligence systems and automated tools capable of generating outputs, processing user inputs, and executing user-configured workflows. Such systems may operate with varying degrees of automation and may involve interactions with third-party service providers, APIs, and model providers.

The Service is provided as a technology platform designed to assist users and does not replace human judgment or constitute the provision of professional, financial, legal, or other regulated services. Any outputs, recommendations, or actions generated through the Service are provided for informational and operational assistance purposes only and remain subject to user review, validation, and control.

2. Accounts

When you create an account, you must provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality and security of your account credentials and for all activities that occur under your account.

You agree not to share your account credentials or allow unauthorized access to your account. You are solely responsible for any actions, instructions, or configurations executed through your account, including those performed by automated workflows or AI systems associated with your account.

You must notify Gen6 immediately of any unauthorized access, suspected security breach, or misuse of your account. Gen6 reserves the right to suspend or terminate accounts that violate these Terms, pose a security risk, or are used in an unauthorized or unlawful manner.

3. Intellectual Property

All intellectual property rights in the Service and its original content, design, and functionality are owned by Gen 6 Technologies, the parent company of Gen6, or its licensors. Gen6 is licensed to use and sublicense these rights to users and partners solely for the operation and provision of the Service.

You may not:

• copy, modify, distribute, sell, or lease any part of the Service;
• reverse engineer, decompile, or attempt to extract the source code or underlying models, except where permitted by law;
• use the Service in a manner that infringes the intellectual property rights of Gen6 or any third party.

You may not use Gen6’s trademarks, trade names, or branding without prior written consent.

4. User Content

You may submit, upload, or share content such as text, graphics, videos, or other materials (“User Content”) through the Service.

You retain ownership of your User Content. By submitting it, you grant Gen6 a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, use, reproduce, display, and distribute it as necessary to operate, maintain, and improve the Service, and to enable integrations with third-party providers (e.g., Supabase or AI model APIs).

Important: For clarity, data obtained from Google Workspace APIs (e.g., Gmail, Drive, Calendar) will only be used to provide user-requested features and will not be used to develop, train, or improve any generalized or non-personalized AI/ML models. Any license you grant to Gen6 over such Google user data is limited to operating the Service for you and does not include rights to use that data for generalized model training or improvement.

You acknowledge that User Content may be processed by automated systems, including artificial intelligence models and workflows, in order to provide the Service and generate output. You remain solely responsible for the legality, accuracy, and appropriateness of your User Content.

You represent that you own or have sufficient rights to the User Content and that its submission does not infringe upon third-party rights.

Gen6 reserves the right to remove infringing or unlawful material and terminate accounts of repeat offenders.

5. AI Outputs and Model Providers

The Service may generate AI outputs using third-party model providers such as OpenAI, Anthropic, Google, or Groq. You retain ownership of your AI-generated outputs, subject to the model providers’ terms.

Where AI processing involves third-party providers, Gen6 configures such providers in no-training modes (or equivalent contractual commitments) so that API inputs and outputs are not used to train or improve the provider’s generalized models. Data is transmitted only as necessary to fulfill the user-requested operation and may be retained temporarily for safety, abuse prevention, or debugging in accordance with provider policies.

You must comply with each provider’s terms of use, particularly regarding commercial use, resale, and content restrictions. These third-party terms may limit how AI-generated content can be used, and users are solely responsible for ensuring compliance.

AI outputs are informational and should not be treated as professional, financial, or legal advice. Gen6 and its partners disclaim responsibility for:

• the accuracy or legality of AI-generated content;
• decisions made based on such outputs;
• any outcomes resulting from automated or AI-assisted workflows;
• errors, limitations, or actions of third-party model providers.

6. Acceptable Use

You agree not to use the Service in any unlawful, abusive, or harmful manner, including (without limitation):

• Violating laws or regulations
• Exploiting or harming minors
• Sending spam or unauthorized communications
• Transmitting malware or scraping data
• Infringing intellectual property rights
• Interfering with Service integrity or security

You must comply with all applicable terms of third-party providers integrated into the Service and must not misuse or abuse such integrations. Gen6 reserves the right to investigate, suspend, or terminate accounts that violate this section.

7. Data Protection and Privacy

Gen6 processes personal data in accordance with the UK GDPR, EU GDPR, CCPA/CPRA, and other applicable laws. By using the Service, you acknowledge that your data is handled per our Privacy Policy.

8. Google Workspace Data & Limited Use

Gen6’s integrations with certain Google Workspace APIs (e.g., Gmail, Drive, Calendar) are governed by the Google API Services User Data Policy, including the Limited Use requirements. Data obtained from Google APIs:

• is accessed and processed only to provide the user-requested functionality and in the minimum scope necessary;
• is not transferred or sold for advertising or marketing purposes;
• is not used to develop, train, or improve generalized or non-personalized AI/ML models, whether by Gen6 or its third-party providers; and
• may be transmitted to vetted AI providers solely to generate a user-specific response under no-training contractual commitments and limited retention.

Access to Google user data is restricted and protected, and is not accessed by humans except where necessary for security, abuse prevention, or compliance with applicable law.

Nothing in these Terms grants Gen6 any rights to use Google user data beyond what is necessary to operate the Service for you in compliance with the Limited Use requirements.

9. Service Availability and Security

Gen6 uses Supabase and other reputable service providers for secure hosting and data management. While robust safeguards are implemented, no system is immune from risks inherent to online data transmission.

Accordingly, Gen6 does not guarantee uninterrupted, secure, or error-free operation of the Service.

10. Termination

Gen6 may suspend or terminate your access to the Service at any time for breach of these Terms, misuse, or legal compliance. Upon termination, all rights to use the Service immediately cease.

11. Limitation of Liability

To the maximum extent permitted by law, Gen 6 Technologies, Gen6, and their affiliates are not liable for any indirect, incidental, or consequential damages, including loss of data or profits.

Notwithstanding the foregoing, in no event shall the total aggregate liability of Gen 6 Technologies (or Gen6) for all claims arising out of or related to these Terms or the Service exceed the greater of: (a) the total amount paid by you to Gen6 in the six (6) months preceding the claim, or (b) One Hundred U.S. Dollars ($100 USD).

12. Export Control and Sanctions

You may not use the Service in violation of any export-control or sanctions laws applicable in the U.S., U.K., E.U. or other relevant jurisdiction.

You represent and warrant that:

• you are not located in, organized under the laws of, or ordinarily resident in any country or territory subject to comprehensive sanctions or embargoes;
• you are not listed on any government sanctions or restricted party list;
• you will not use the Service for any purpose prohibited by applicable export control or sanctions laws.

You must not access or use the Service:

• in violation of any applicable export control or sanctions laws;
• for the benefit of any sanctioned individual, entity, or jurisdiction;
• in connection with any prohibited end-use, including activities related to weapons proliferation or other restricted activities where applicable.

Gen6 reserves the right to restrict, suspend, or terminate access to the Service where required to comply with applicable export control or sanctions laws.

13. Disclaimer

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. Gen6 specifically disclaims any warranty that AI-generated content does not infringe the intellectual property or proprietary rights of any third party.

AI-generated outputs and automated workflows are provided for informational and operational assistance purposes only and should not be relied upon as the sole basis for decisions.

14. Copyright Policy

Gen6 respects intellectual-property rights and processes valid notices of infringement. Refer to this Copyright Policy section for detailed procedures.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. The courts of London, United Kingdom have exclusive jurisdiction.

16. Changes to Terms

We may modify these Terms at any time with notice. Continued use after changes take effect constitutes acceptance.
